Legislation introduced under the "Health & Safety at Work Act", places a duty of care on employers & individual directors of companies to ensure that employees who undertake driving duties are competent. The HSE are increasingly prepared to prosecute companies who fail to meet legal obligations with regards to work related driving activities. Prosecutions against company directors are also increasing in frequency.
By introducing a structured driver improvement programme you are helping to protect both yourself & your business both from the consequences of corporate responsibility and personal liability.
A question you should ask yourself is: - "If an employee driving in a private or company car on business was involved in an accident causing death or personal injury today, could your company and its directors prove they had done everything they could to meet the required duties of care"?
If you are unsure then we believe you need our professional help!

In September 2003 the HSE in conjunction with the Department of Transport produced guidance aimed at employers, managers and supervisors whose staff drive or ride a motorcycle or bicycle at work. The guidance driving at work managing work related road safety' is available on the HSE's website at www.hse.gov . uk/pubnsJindg382 . pdf

Considering that there were 3221 fatalities on the road during 2004 and an estimated 800 to 1000 of these were work related, driving at work is fast becoming one of the biggest health and safety issues for employers. Unfortunately driving is also amongst the most overlooked risks by many employers.

If an employee drives on company business (even if they use their own vehicle) this is considered to be a part of the company's 'undertaking' and as such health and safety legislation applies. As with all risks, the activity must be risk assessed.

The Police Road Death Investigation Manual has been updated in line with the HSE guidance. Any road death will be regarded as 'work-related' if the employer's failure to manage safety significantly contributed towards the fatality.
