In September 2003 the HSE in conjunction with the Department of Transport produced guidance aimed at employers, managers and supervisors whose staff drive or ride a motorcycle or bicycle at work. Considering that there were 3221 fatalities on the road during 2004 and an estimated 800 to 1000 of these were work related, driving at work is fast becoming one of the biggest health and safety issues for employers. Unfortunately driving is also amongst the most overlooked risks by many employers.
If an employee drives on company business (even if they use their own vehicle) this is considered to be a part of the company's 'undertaking' and as such health and safety legislation applies. As with all risks, the activity must be risk assessed.
The Police Road Death Investigation Manual has been updated in line with the HSE guidance. Any road death will be regarded as 'work-related' if the employer's failure to manage safety significantly contributed towards the fatality.
